Drug precursors: amendments to the Annex IV of Regulation (EC) n. 1277/2005

The Italian customs Agency, supplementing the notice n. 32/D of 3 August 2005 (concerning the proper application of the discipline on drug precursors and basic chemical products trade), informs with the new Notice N. 12/D of 30 April 2009, that in the Official Journal of the European Union of 9 April 2009, L 95, the Commission Regulation (EC) n. 297/2009 of 8 April 2009 (annexed to the notice) has been published. Such a Regulation has amended the Annex IV of Regulation (CE) n. 1277/2005, listing those third Countries currently requiring special monitoring measures on the export from the Community towards their territory of drug precursors.

New restritions established by the EU Commission to the introduction into the Community of certain species of wild fauna and flora

The Washington Convention on the International trade in Endangered Species of Wild Fauna and Flora, better known as "CITES", is entered into force in 1975 (currently 175 Countries are Parties) with the aim of safeguarding from the danger of extinction a list of 25.000 vegetable species and 5.000 animal species. Moreover, the Convention establishes a rigid regulation system of monitoring of the trade of animals, both living and dead, as well of their parties or derivatives, in order to prevent extreme commercial deployment and the desrtuction both of the species and their natural habitat. Such objective is realized through a complex system of import/export licences, authorizations and certifications falling within the competence of national authorities (in the majority of cases these are the local Ministries for the Environment or Agriculture).

Mincomes launches a new area on its web site devoted to import/export licences and refunds on agricultural products

The Italian Ministry for Economic Development - Department of enterprises and internationalization, with Communiqué Prot. n. 20090031342 of 24 April 2009, informs that starting from 17 April 2009 a new area is available on its web site (www.mincomes.it), where operators can find all the information available on import/export licensing procedures, as well as on anticipated refunds on agricultural products.

With particular regard to agricultural products, import/export operations with third Countries falling within the common organisation of agricultural markets (Council Regulation n. 1234/07 of 22.10.2007) are subject in some cases to the release of a special import or export license issued (in Italy) by the Italian Ministry for Economic Development - Department of enterprises and internationalization, under the conditions set forth by Commission Regulation n. 376/08 of 23.04.2008.

Italian customs tests new RFId technologies

Italian Customs have developed in their website an area where the main characteristics of the new system based on the use of the radio-frequency technologies are illustrated. Such a system, called "Il Trovatore" is based on the RFId technologies (the acronym stands for "Radio-Frequency Identification") and is aimed to control the integrity and the electronic tracking of the container movements, in order to optimize the goods flow, guarantee a better use of the stockage areas (so reducing the costs of logistics) and simplify the clearance formalities. This is supposed to improve the control of the commercial traffic in the complex.

Centralized clearance: Convention among the member States regarding the re-distribution of the national quota of customs duties

In the Official Journal of the European Union C 92 of 21 April 2009, the Convention among EU Member States concerning the centralized clearing is available. This Convention deals with the allocation of national collection costs retained when traditional own resources are made available to the EU budget. The "centralized clearance" concept, introduced by the new "Modernized" Community Customs Code (art. 106), is the possibility, for economic operators to lodge or make available, upon authorization of customs authorities, a customs declaration at the customs office competent for the place where they are established, included for those goods that are physically presented to other customs offices. Such mechanism allows companies to clear their goods "at distance" (this is an option particularly interesting for multinational companies), dealing with a single customs office for execution of all their formalities (the office competent for the place where their headquarters are located).
