On July 2009, Regulations (EC) No 598/2009 and 599/2009 were published in the Official Journal of the EU. Those acts have established, respectively, a definitive countervailing and a definitive anti-dumping duty on imports of biodiesel originating from the USA (see our articolo), and collecting definitively the provisional duties established with Regulations (EC) n. 193/2009 and 194/2009.
With the implementing Regulations (EU) No 443/2011 and No 444/2011 of the Council, of 5 May 2011, said countervailing and anti-dumping duties are now been extended from the import of biodiesel in pure form to those in blend containing a percentage (in weight) equal or inferior to 20% of biodiesel originating from U.S.A. The same duties apply also to the biodiesel consigned from Canada, whether declared as originating in this Country or not, with the only exclusion of the biodiesel produced by the companies listed to the article 1 of both the Regulations and with the possibility to ask to the EU Commission a specific exemption from duties by those companies that have not circumvented the countervailing and anti-dumping measures established by the Regulations of 2009.
