A proclamation of the United States President of 31 October 2011 announces a change in the tariff classification in the USA for imported footwear with soles of rubber or plastic to which a layer of textile material has been added, The Annex I of the proclamation, which describes the new classification criteria, has however not yet published. The proclamation, that enters into force 20 days after its publication in the Federal Register, will amend in particular the Chapter 1205 of the Harmonized Tariff Schedule (HTS) of the United States. What we know so far is that the US customs will adopt a precise standard based on strength and/or durability of the soles, which will be decisive for the inclusion of the footwear in the new classification criteria.
Si ricorda che negli Stati Uniti, l’art. 3006/a del Titolo 19 dello United States Code (U.S.C.), ossia il codice delle leggi federali degli Stati Uniti, prevede il diritto del Presidente di adottare modifiche dell’HTS su impulso della United States International Trade Commission (USITC).
Il proclama in questione entrerà in vigore dopo 30 giorni dalla pubblicazione nel Federal Register (la Gazzetta Ufficiale americana), salvo eventuali proroghe.
